Should You Contest an Unemployment Claim?

Is Your Employee Eligible for Unemployment Benefits?

If the employee resigned voluntarily, not under some duress caused by the employer, they are probably not entitled to unemployment claim benefits. If they were terminated for poor performance, unless of a kind which might be considered a form of misconduct, they probably are entitled to unemployment claim benefits.

Whether or not there was misconduct is not always easy to determine, but we can provide you with the assistance you need to make that determination. Often, if the initial challenge, particularly the first hearing, is not handled well by the employer, the employee might prevail even if the employer had a good basis to challenge.
